In many divorces, the determination of how much spousal support is paid and for how long is the primary issue in the divorce. This is especially true where the couple’s assets are limited and/or easy to value, or where there is a significant gap in income between the parties. Spousal support can determined through an agreement or through a judge’s order.
Both temporary and ongoing spousal support are available in a California divorce action to either a husband or wife:
Temporary spousal support. A spouse who makes less income than the other spouse can petition the court for temporary spousal support at the beginning of divorce proceedings in order to have financial stability throughout the course of the divorce. A judge will customarily plug the two spouses’ incomes into a formula to achieve temporary support amount. This spousal support will be paid for the duration of the divorce proceedings (which can persist for an extended time), and the judge will then make a determination regarding how much, if any, support should be paid following the divorce.
Ongoing spousal support. This type of spousal support will be paid following the finalization of the marriage. For longer marriages, it may be permanent in nature or last until the payee spouse remarries. For shorter marriages, it will often be of limited duration, roughly half the length of the marriage. Although child support calculations are based on a statutory mathematical formula, judges have significantly more discretion to make determinations of spousal support. In California, spousal support determinations are based on a number of factors, including:

- Skills and educational training of the dependent spouse
