Legal Custody
We often work with parents who want to learn more about legal custody. In short, legal custody is the term for a type of custody in which a parent gets to make important decisions about the child’s upbringing and welfare. For example, legal custody allows a parent to make decisions about a child’s education, healthcare, and religion. We want you to know that courts want to give joint legal custody to both parents so they can share in these important decisions. However, we also want to emphasize that you will need to show the court that you can communicate effectively with your spouse.
Physical Custody
We know you must have so many questions about the types of custody, and we want to clarify that physical custody is a term that refers to the day-to-cay care of your child. If a parent is awarded physical custody, the child will live with that parent. California courts really do want to be able to award joint physical custody to parents and typically will do so unless there are issues of substance abuse or family violence. Even if a parent is not granted physical custody, that parent may get visitation rights.
